civil law countr...This issue is also discussed in <br />civil law countries (i.e. Germany and Switzerland) where the claim of <br />the foreign manufacturer to obtain the transfer of trade marks <br />registered by its local agent/ distributor depends (among other conditions) on whether the local agent/distributor had such a <br />fiduciary duty.<br /><br />I have recently written a paper addressing this issue (in French) in which I also analyse the international framework <br />(i.e. art. 6septies of the Paris Convention). Moorgate was the successor in title to the original licensor and was a member of the BAT Group. The citation is 1984 156 CLR 414.
